Terms of Service

Horizoney is an online business hosting platform operated by Horizoney Company Limited, registered in Dodoma, Tanzania. The platform enables sellers ("Shop Owners") to create digital storefronts and list products or services, and enables buyers ("Customers") to discover, browse, and contact those sellers directly.

Horizoney acts as a marketplace and does not itself buy, sell, hold inventory, or take ownership of any goods or services listed on the platform. All transactions are conducted directly between buyers and sellers.

To use Horizoney, you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate, current, and complete registration information.
• Not be prohibited from using the platform under applicable law.

By using the platform, you represent and warrant that you meet all of the above eligibility requirements.

You must create an account to access most platform features. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@horizoney.com if you suspect unauthorised access to your account.

You may not share your account credentials with any third party. Horizoney reserves the right to suspend or terminate accounts that are found to be shared, compromised, or used in violation of these Terms.

If you operate a shop on Horizoney, you agree to:

• Provide accurate and truthful information about your shop, products, and services.
• Only list products or services that you have the legal right to sell.
• Keep product listings up to date, including accurate prices, stock levels, and descriptions.
• Respond to customer enquiries in a timely and professional manner.
• Honour the terms of any sale you agree to with a customer.
• Comply with all applicable Tanzanian laws and regulations, including consumer protection and trade laws.
• Not engage in deceptive, misleading, or fraudulent listing practices.

Horizoney reserves the right to remove any listing or suspend any shop that violates these responsibilities, without prior notice.

You may not use Horizoney to:

• List or sell illegal goods or services, including counterfeit items, controlled substances, weapons, or stolen goods.
• Post content that is defamatory, obscene, hateful, discriminatory, or violates the rights of any person.
• Impersonate another person, business, or entity.
• Upload malicious code, scripts, or files of any kind.
• Scrape, harvest, or systematically collect data from the platform without written permission.
• Interfere with or disrupt the platform's infrastructure, servers, or networks.
• Engage in spam, unsolicited messaging, or any form of harassment of other users.
• Circumvent any access controls, security features, or verification processes on the platform.

Horizoney provides the platform and tools that facilitate connections between buyers and sellers. Horizoney is not a party to any transaction between a buyer and a seller. All agreements, payments, and disputes arising from such transactions are solely between the buyer and the seller.

Horizoney does not guarantee the quality, safety, legality, or availability of any products or services listed on the platform, nor does it guarantee that a seller will complete a transaction or that a buyer will make payment.

Users are encouraged to exercise due diligence before engaging in any transaction and to communicate directly via the contact methods provided on a seller's shop page.

Users may leave reviews and ratings for shops and products. By submitting a review, you agree that:

• Your review reflects your genuine, first-hand experience.
• You will not post fake, incentivised, or defamatory reviews.
• Horizoney may remove reviews that violate these Terms or that are determined to be fraudulent.

The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Horizoney Company Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from:

• Your use of or inability to use the platform.
• Any transactions conducted between buyers and sellers via the platform.
• Unauthorised access to or alteration of your account or data.
• Any bugs, errors, or service interruptions on the platform.

You agree to indemnify, defend, and hold harmless Horizoney Company Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the platform in violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you upload or submit to the platform.

You may terminate your account at any time by contacting us at support@horizoney.com.

We reserve the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the platform ceases immediately. Content you have uploaded may be retained for a period of time as required by applicable law or legitimate business purposes, then deleted.

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from or relating to these Terms or your use of the platform shall first be attempted to be resolved amicably. If resolution cannot be reached within 30 days, disputes shall be submitted to the jurisdiction of the competent courts of Tanzania.

We may modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you via email or an in-app notification at least 14 days before the changes take effect. Your continued use of the platform after that date constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the platform and may request account deletion.
